SIDNEY -- Cheyenne County Attorney Paul Schaub and Cheyenne County Chief Deputy Attorney Amber Horn said this morning complaints were filed against youth ages 11 to 14.

The 11-year-old is too young for felony charges and was offered a Diversion program. Nebraska State Statutes do not allow a child under 12 years of age to face a felony charge.

Authorities said there was damage at Legion Park, a break-in at the City of Sidney power plant, a vehicle was stolen from a Sidney business and totaled and a private shop was broken into. Much of the crimes occurred primarily in the Thanksgiving period, authorities said.

Chief Deputy Attorney Horn said a special prosecutor has been assigned to the case because she is connected to one of the alleged victims. Schaub said when one of the office staff is in conflict, the entire office is conflicted. Kimball County Attorney Dave Wilson has been appointed as the special prosecutor.

Because of their ages, names were not available. All of the children are males.

Suspect 1 is facing complaints of  Criminal Mischief, Damaging Property of Power Supplier, two counts of Burglary, Theft, Criminal Mischief and Use of a Weapon.

Suspect 2 is facing complaints of Criminal Mischief, Damaging Property of Power Supplier, Burglary and Criminal Mischief.

Suspect 3 is facing two counts of Criminal Mischief, Damaging Property of a Power Supplier and Burglary.

Suspect 4 is facing complaints of three counts Criminal Mischief, Damaging Property of Power Supplier, two counts Burglary, Theft, and Use of a Weapon.

Complaints filed against Suspect 5 include Criminal Mischief, Damaging Property of Power Supplier, three counts Burglary, two counts Theft and Use of a Weapon.

One of the children is also facing an arson complaint.

Horn said she expects the first court appearances to take place the first week of January.

Sidney Police Chief Joe Aikens thanked the community members who provided information leading to identifying the adolescents.
