SIDNEY, NE — A Sidney's mans court case will move ahead as planned after the Nebraska Supreme Court denied his motion to move the case to juvenile court.
SIDNEY, NE — A Sidney's mans court case will move ahead as planned after the Nebraska Supreme Court denied his motion to move the case to juvenile court.
Jessey Lohman is charged with use of a deadly weapon to commit a felony and second-degree assault after an incident in Sidney's Legion Park August last year. At the time of alleged attack, Lohman was 17-years-old. The Cheyenne County Court, however, charged him as an adult.
Lohman filed a motion to move the case to juvenile court, but the district court in Cheyenne County denied that motion.
The decision then went to the Nebraska Supreme Court when Lohman appealed the decision. Earlier this month, the state's highest court announced they upheld the Cheyenne County District Court's decision.
The Nebraska Supreme Court said it found, "no abuse of discretion in the district court's order denying the motion to transfer." Lohman turned 18 in December, between when he filed the appeal and when the decision was given.
Court records do not indicate when Jessey is due back in court now that the appeal has been denied. Jessey's mother, Jamie is charged with felony child abuse in the case. She has pleaded not guilty to the accusation. Authorities say Jamie was present the night of the assault and played a role in instigating it.
